VETERANS CORNER: There is always the advancement to an R-1 rating

Over the past 40 years I have advocated for hundreds of veterans, perhaps more. I have seen so many 100 percent cases I can’t remember. Eventually I will hear many say, “is this all there is”? Although most are very happy receiving the 100 percent there is always the question, “is there more”? The answer is simple, “yes”. However, after the 100 percent award there must be some serious disabilities available for exploration for upper level consideration.

The upper level of care is called S.M.C., which is Special Monthly Compensation. The burden of proof rests with the veteran and must meet certain criterion, according to V.A. standards. This area of compensation is identified by certain letters of the alphabet; which I will not break all of them down. The letter “K” is the most used which is for certain problems such as loss of use of a limb. This will allow the veteran a permanent cash benefit over and above their 100 percent rating. The last time I looked it was about $138.80. This is separate and permanent. These amounts can add up if you have multiple lettered issues, I believe you are allowed up to 3 letter “K” awards as well as others. So, if you are married with 100 percent rating you would be receiving a little more than $4,044 per month. If you have, say two K factor disabilities as well, you would receive $4,323.74. It can be even more if you fill the requirements for other letters such as L, M, N, O or even another K, then there is always the advancement to an R-1 rating which can bring your disability amount up to near $10,000 per month. That pathway is a lot more difficult to navigate and Aid and Attendance must be needed. V.A. is very reluctant to give that one. This does not require professional care, doctor, nurse etc.

If you are an amputee, say hand foot that is on its face is a letter K. If you have two such afflictions that would most likely lead to Aid and Attendance which would most likely satisfy the requirements for R-1 entitlement. Your need for a caregiver by the standards set by VA should be fulfilled.

Of course, VA holds strict compliance to their guidelines as they would be elevating you to one of the highest monetary levels. There many benefits in acquiring this rating. You will see vehicle allowance, tax breaks, electric chairs or scooters and handicap hardware affixed to your vehicle. There are also allowances for handicap home adaptations. It’s well worth the pursuit if you meet the criteria. Your advocate can fill you in on the requirements and benefits.

I would be remiss if I neglected to mention that you don’t need to lose a limb to qualify but you do have to lose the effective use of the limbs. Follow the guidelines for the need for a caregiver to obtain the correct pathway.
